The origin rule nobody can waive

Transhipment does not change origin. Goods produced in mainland China and re-exported through Hong Kong are still Chinese origin for US Section 301, EU, UK and Australian duty purposes. Goods substantially transformed in Thailand, Vietnam, Malaysia or Indonesia are ASEAN origin, and you should be able to prove it with a bill of materials, production records and the relevant certificate of origin. A switched bill of lading that hides the production country is not a duty strategy — it is a penalty waiting to be assessed.

When Hong Kong still makes sense

  • You buy from several mainland suppliers and need one consolidated container.
  • Your supplier's export licence or banking sits offshore and cannot be restructured quickly.
  • You need repacking, kitting or relabelling before the goods reach your market.
  • Volumes are LCL and consolidation savings beat the extra handling.

When direct from ASEAN wins

  • Production is already in Thailand, Vietnam, Malaysia or Indonesia — routing through Hong Kong adds cost and no value.
  • You want the shortest possible document chain for customs and for your own audit.
  • You are claiming an ASEAN preferential origin or avoiding China-origin duties legitimately.
  • You need traceability to a named factory for retailer or regulatory compliance.

Documents to demand either way

Commercial invoice and packing list matching the purchase order line for line; certificate of origin naming the true production country; clean on-board bill of lading; test reports for the destination market (FCC, CE/UKCA, RCM, FDA as applicable); pre-shipment inspection report; and, for wooden or agricultural content, a fumigation or phytosanitary certificate. Any gap here is what stops a container at the port, not the shipping route itself.
