Import from Thailand to USA: Country of Origin Marking 2026
Every article of foreign origin entering the US must be marked with its country of origin in a conspicuous place, legibly, indelibly and permanently. For Thai imports this sounds simple until you have Chinese components, Thai assembly, and a US retailer with its own packaging spec.
Substantial transformation: is it really Thai?
Origin is not where the container shipped from. It is where the last substantial transformation occurred — a change in name, character or use. Rules of thumb CBP applies:
- Yes, Thai origin: Chinese steel coil cut, formed, welded and painted into a finished bracket in Thailand
- Probably yes: Injection moulding in Thailand from imported resin
- No: Chinese finished goods repacked or labelled in Thailand
- No: Simple assembly of a complete knock-down kit with screws

Where the mark must appear
- On the article itself where feasible (moulded, etched, sewn label, permanent sticker)
- On the retail container if the article cannot be marked
- Readable by the ultimate purchaser at the time of purchase — a mark on the master carton only is not enough for consumer goods
Acceptable wording: "Made in Thailand", "Product of Thailand", "Assembled in Thailand" (when accurate). Avoid abbreviations, flags without wording, or non-English text.
Marking duty: the 10% surprise
Goods found improperly marked incur 10% marking duty on entered value under 19 U.S.C. 1304(i), plus the cost of remarking under CBP supervision at a bonded facility. For a $60,000 container that is $6,000 you did not budget.
Special cases
- J-List articles (screws, nails, raw materials, some natural products) may be exempt from individual marking, but the container must be marked

Get it right at the factory
Put marking in the PO and the artwork approval, not in an email. Verify on the pre-shipment inspection with photos of the actual mark on production units, not golden samples.
FAQ
Is "Made in Thailand" on the box enough?
Only if the consumer sees that box at purchase and the item itself cannot reasonably be marked. For most consumer goods, mark the item.
Can I label goods in the USA after import?
Yes, under CBP supervision at a bonded warehouse or FTZ, but you pay the handling and possibly the 10% marking duty. Far cheaper to mark in Thailand.
Does Chinese content change my origin to China?
Only if Thailand's processing does not substantially transform the inputs. Component origin alone does not determine origin.
Do I need to declare the Thai factory name to CBP?
The manufacturer identification code (MID) derived from the factory name and address is required on entry and ISF.
Is a printed sticker acceptable as permanent marking?
Only if it survives normal handling until the ultimate purchaser. Die-cut destructible or moulded marks are safer for durable goods.
