Section 301 vs Thailand
As of Jan 2026, Thailand has no Section 301, Section 232, or IEEPA tariffs from the USA. Compare to China: 25% on List 3, up to 100% on EVs, plus IEEPA reciprocal tariffs. This is why sourcing shifted USD 40B+ from China to Thailand 2018-2025.
Form D / Form E / RCEP: getting duty preference
- Ask supplier to issue Certificate of Origin (Form D for ASEAN, Form JTEPA for Japan, Form RCEP for RCEP).
- Cost: USD 30-80 per set, issued by Thai Department of Foreign Trade (DFT).
- Submit original to your customs broker at entry.
- Product must meet Rules of Origin (usually 40% RVC or CTC criterion).
Australia (AANZFTA / TAFTA) & Canada (GPT)
- Australia: 99% of Thai goods enter at 0% under TAFTA. Form FTA required.
- Canada: Thailand loses GPT eligibility 2027; currently 0% on many categories. No FTA. Use MFN post-2027.
FAQ
Q: Do I always get FTA duty preference? A: Only if (1) product meets Rules of Origin, (2) you have valid Form D/E/RCEP at entry, and (3) direct shipment (no substantial processing in transit country).
Q: What if HS code is disputed at customs? A: Request a binding tariff ruling (USA: CBP CROSS; EU: BTI; UK: ATaR) before shipping — free and takes 30-60 days.
Q: Are there Section 232 steel/aluminum duties on Thai imports? A: Steel: yes, 25% Section 232 still applies to Thai steel HS 7208-7229. Aluminum: 10% Section 232. Downstream products (auto parts, appliances) mostly exempt.
Q: Does Thailand have export tax? A: Yes on very few items: raw wood, hides, some agricultural raw materials. Finished goods: no export duty.
Q: How do anti-dumping duties work? A: Check USITC / EU TRON / UK TRR for active AD/CVD orders on Thai products (e.g. steel wire rod, tires historically). Rare vs Chinese imports but not zero.
